For a subpoena to be valid, it must:

• Include the court/jurisdiction, case number and contact information of requestor
• Be issued to the proper Discover Financial Services Entity
• Be signed and dated by the proper court and/or officer of the court
• Provide an adequate description and/or information with which to identify responsive documents (i.e. account numbers, SSN, name & DOB)

Provide an email address in case further information is needed as well as to deliver responsive documents.

Subpoenas should identify with specificity what is being requested. Vague or general language seeking “any and all” documents may necessitate further clarification or delay. If a time period is not provided, then we will produce the last 6 months of available records.

Subpoena Fulfillment time is approximately 30-45 calendar days after proper service. More time may be needed if extensive information is being sought or if insufficient information is provided.

Discover Financial Services reserves the right to charge reasonable fees for its fulfilment of subpoenas while complying with exceptions under state/federal law governing rates. The fees are:

Additional fees may apply for miscellaneous requests and a minimum of one (1) hour labor fee is assessed.

*Please do not remit payment until you receive an invoice. Any prepayment checks that accompany a subpoena will not be processed and will be destroyed upon receipt.
